Loss of Earnings Capacity Assessment by Vocational Expert

  • Quantify an injured individual's nominal loss of earnings capacity based on the difference between pre-injury and post-injury earnings capacity

  • Utilized when the injured individual was able to work at the time of the injury, but since the injury is unable to do the same type of work for the same amount of time, and a post-injury earnings capacity is expected

  • Typically utilized in conjunction with Present Value Assessment of Loss of Earnings by PhD Economist

Present Value Assessment of Loss of Earnings by PhD Economist

  • Estimation of value of lost earnings, lost earning capacity, mitigation earnings, and retirement benefits

  • If the injured individual was able to work at the time of the injury, but unable to work since the injury, then only a Present Value Assessment is needed.  A Loss of Earnings Capacity Assessment by Vocational Expert is not needed

  • If the injured individual was able to work at the time of the injury, but since the injury is unable to do the same type of work for the same amount of time, then both a Vocational Loss of Earnings Capacity Assessment and a Present Value Assessment of Loss of Earnings are typically utilized
